—Appeal by the defendant from a judgment of the Supreme Court, Kings County (Owens, J.), rendered October 17, 1986, convicting him of arson in the second degree, reckless endangerment in the first degree (two counts), and criminal mischief in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed, and the case is remitted to the Supreme Court, Kings County, for further proceedings pursuant to CPL 460.50 (5).
