Memorandum: Defendant was convicted of criminal possession of a controlled substance in the first degree (Penal Law §220.21 [1]) and criminally using drug paraphernalia in the second degree (Penal Law § 220.50 [2]) for knowingly and unlawfully possessing more than four ounces of cocaine and related drug paraphernalia on Novem*997her 26, 1991 in the County of Ontario.
