The first four counts in the indictment in this case for obtaining money by false pretenses, it is insisted, should have been quashed on the defendant’s motion : First— because to constitute this crime, itisindispensibly necessary that the prosecutor should have been induced to part with his money by relying on the false representations of the accused; and that this should be alleged in the indictment.
