This is an action- brought by the plaintiff Olivia Skramstad, surviving widow, of Alvin M. Skramstad, deceased, on behalf of herself and three minor children, against Clarence Miller for damages under the wrongful death statute. The complaint alleges that the deceased was killed in a collision between *453a truck loaded with coal, driven by the deceased and a road scraper and caterpillar tractor negligently operated by the defendant’s driver, Mason Teigen, and that the deceased was killed as a result of the negligence of said Mason Teigen.
