WARD, Circuit Judge.

Kessler & Co., bankers of New York City, drew two sets of drafts, original and duplicate, one only to be paid, to the order of the Armstrong Cork Company on a. bank in Paris, and put the bank in funds to pay the same. The Cork Company sent the originals by mail, duly indorsed, to the order of Matas Hermanos, but the. same were stolen, and presented to the drawee with a forged indorsement in the name of Mata Hermanos, omitting the final “s” in Matas, to the order' of; B. Eauriez. The drawee paid the person presenting the drafts, who was unknown to it, arid who was not B.…
