This case was brought up, by writ of error, from the Supreme Court of the Territory of Minnesota. By stipulation of counsel, Secombe was made the representative of numerous other parties engaged in a common cause. The chronological history of the case was this. In the latter part of 1851, suits were pending between Steele and Arnold W. This cause comes before this court upon a writ of error to the Supreme Court of the Territory of Minnesota.
The defendant in this court (Steele) instituted a suit in the District Court of Ramsey county, Minnesota Territory, against fifty-four defendants, to determine the validity of their “ claim,” “estate,” or “interest,” in certain real property at St. Anthony’s Palls, in that county, of which he was possessed, and in which he claimed to have an estate in fee simple, under certain conveyances, which are appended to his complaint.
