HUXMAN, Circuit Judge.

This is an appeal from an order of the trial court denying petitioner’s application for a writ of habeas corpus. On October 20, 1937, an indictment was returned against petitioner in the District Court of the United States for the Western District of Louisiana, charging him in six counts *668•with violations of the United States statutes, 18 U.S.C.A. § 387, forbidding the carrying of lottery tickets in interstate movements.
