PHILLIPS, Circuit Judge.
Bartlett, Edwards, Walker-Smith Company, 1 and Kee were charged by indictment with a violation of 18 U.S.C.A. § 88. Five other individuals were also charged as co-defendants but the indictment was dismissed as to them and the Company.
The indictment charged that the defendants conspired to violate laws of the United States respecting the rationing of sugar and the control of sugar prices; that the conspiracy was to be carried out in substantially the following manner: That Bartlett, with the consent of the Company and Kee, its manager at Hobbs, New Mexico, would issue…
