PHILLIPS, Circuit Judge.

This is an appeal from a judgment denying a petition for a writ of habeas corpus.

Two indictments were returned against the petitioner in the District Court of the United States for the Eastern District of Kentucky. The first indictment, numbered 9205, charged that petitioner on or about January 15, 1937, in the Eastern District of Kentucky knowingly did receive, conceal, buy, and sell and facilitate the transportation, concealment, and sale, after importation into the United States contrary to law, of 8026 grains of heroin, a certain derivative and preparation of…
