CHESNUT, District Judge.
Roy L. Mann, one of the three defendants in the above case, has now filed a *843motion for modification of the sentence imposed on him on June 3, 1949, by the suspension of a portion of that sentence and the placing of the petitioner on probation upon the suspension of the sentence.
The indictment was filed May 17, 1949 containing 7 counts. The first three counts, based on section 2113 of title 18 of the United States Code, charged in substance the robbery of the Occident Federal Savings and Loan Association (a federal savings and loan association) in Baltimore City on or…
