JONES, District Judge.
I. Background
The Constitutional Guided Walking Tours, LLC and its owners, Jonathan H. Bari and Leslie S. Bari (hereinafter collectively referred to as “Plaintiffs”), were engaged in the operation of a commercial walking tour of Independence National Historical Park (INHP) and the surrounding area between the years of 2005 and 2010.1 Defendant National Park Service (NPS) is the federal agency charged with the general oversight of INHP.
