This is an appeal from an order granting a motion for summary judgment filed by the defendant below in a negligence action. Appellant contends that there are material factual issues in dispute and that therefore summary judgment was improperly granted. She also contends that the trial court committed reversible error by granting ap-pellee’s motion for summary judgment pri- or to the lapse of ten days from the time the motion was served on appellant. 1
