MEMORANDUM OPINION AND ORDER
SIFTON, Senior District Judge.
This is a civil action brought by six named plaintiffs in their individual capacities and on behalf of others similarly situated for claims under sections 7(a), 11(c), 15(a)(2)(5), 16 and 17 of the Fair Labor Standards Act, as amended (29 U.S.C. §§ 207(a), 211(c), 215(a)(2)(5), 216 and 217 (2004)) (“FLSA”) and claims under Article 19 of the New York State Labor Law (“NYS Labor Law”) and its implementing regulations, N.Y.
