MEMORANDUM OPINION and ORDER

JENKINS, District Judge.

Defendant Richard A. Von Hake’s Motion to Dismiss the complaint in the above-entitled action pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure came on for hearing before this Court on November 10, 1980.
