I. INTRODUCTION

David Breen (“Breen”) has served approximately 32 months of his 48-month prison sentence for conspiring to manufacture marijuana and moves for resentencing pursuant to 18 U.S.C. § 3582(c)(2) (1994), arguing that a 1995 amendment to the United States Sentencing Guidelines (“Sentencing Guidelines”) 1 reduces his sentence.
