Opinion on rehearing. On April 16, 1976, plaintiff John Chavez, a former probationary employee with the Sacramento County Sheriff’s Department, filed a petition for writ of mandate in the superior court. He alleged that he had been released from employment as a result of discriminatory practices and had appealed such release to the Sacramento County Civil Service Commission (Commission) which after hearing denied the appeal; he had thereupon sought a transcript of the taped hearing to submit to the superior court for review (pursuant to Code Civ.
