ALARCON, Circuit Judge:
Defendant/appellant Burlington Northern Railroad Company (hereinafter BN) appeals from the district court’s grant of a permanent injunction in favor of plaintiff/appellee Brotherhood of Locomotive Engineers (hereinafter BLE).
