HOLMES, Circuit Judge.
There is evidence in the record from which a fair jury may reasonably infer the following facts to be true: On December 18, 1947, J. A. Coop owned a pick-up truck on which he had indemnity insurance with the Home Indemnity Company. At 6 A. M. that day, he and his wife left his home in Collierville, Tennessee, to take their sick child to a hospital in Memphis. Another child accompanied them; this left at home only one member of the family, an eighteen-year-old son named Bryan, who was a senior at high school.
