FORET, Judge.

William Tanner (defendant) was charged by indictment with negligent homicide. On December 17, 1981, defendant filed a motion to suppress the results of a breath analysis test performed on him. The trial court granted the motion, finding that the Department of Public Safety’s regulations governing the use and maintenance of the auto-intoximeter machine were insufficient to insure its accuracy.
