OPINION OF THE COURT

VAN DUSEN, Circuit Judge.

The respondent (Superintendent of a Pennsylvania prison) appeals from a district court order entered after an evidentiary hearing and granting relator a writ of habeas corpus. See United States ex rel. Paxos v. Rundle, 337 F.Supp. 315 (E.D.Pa.1971).

*449Relator and two co-defendants were found guilty by a jury on February 23, 1968, of conspiracy to commit burglary and robbery (# 357), aggravated robbery of Catherine McNally (# 359), aggravated robbery of Edmund McNally (# 360), and burglary with intent to commit robbery (# 361).
