The Moundsville Mining and Manfacturing Company, a corporation formed under the laws of West Virginia, became the-*44owner of a large tract of land, adjoining the town of Mounds-ville. It acquired the land for the purpose of laying it out into building' lots, streets and alleys, with the expectation that it would afterwards become a part of the town. The object of the •company was to sell the building lots, as it was authorized to do by its charter.
