Plaintiff brought this action as the beneficiary under an accident insurance policy issued to Fong Wing, which insured him against "loss resulting from bodily injuries, including death resulting therefrom, effected independently and exclusive of all other causes directly through accidental means." Upon this policy was indorsed a rider or proviso as follows: "Nor shall the company be liable for any injury, fatal or otherwise, resulting directly or indirectly from murder, highbinder acts, or tong wars, anything else in the policy to the contrary notwithstanding."
