This is an appeal from an order granting defendant, Gulf, Mobile and Ohio Railroad Company’s motion for summary judgment.

The original complaint in this action was against Intrusion-Prepakt, Incorporated, and Gulf, Mobile and Ohio Railroad Company, hereinafter called G. M. & 0. A motion to dismiss was filed by Intrusion on the ground that the Workmen’s Compensation Act precluded plaintiff’s recovery against Intrusion. See Moroni v.
