OPINION
BUSH, Judge.
This matter is before the court on defendant’s motion to dismiss for lack of subject matter jurisdiction under Rule 12(b)(1) and, in the alternative, under Rule 12(b)(6) of the United States Court of Federal Claims (RCFC). In this case, plaintiffs allege that the government has appropriated Last Island, an island off the coast of Louisiana, without just compensation.1 Plaintiffs, .however, did not file their takings claim within the six-year statute of limitations set forth in 28 U.S.C. § 2501 (2000).
