This action of assumpsit was brought on April 1, 1933 by the Superintendent of Banks of the State of Ohio (hereinafter called Superintendent) as statutory receiver or officer in charge of the liquidation of The Ohio Savings Bank and Trust Company of Toledo, Ohio (hereinafter called Ohio Bank) an insolvent bank of deposit, against the estate of a decedent, Mary E. C.
