This appeal is from the judgment entered by the court below in an action of assumpsit brought by the Secretary of Banking of the Commonwealth of Pennsylvania as receiver of the insolvent Cqrnwells State Bank against the Frankford Trust Company and Gertude Thomas, trustees under the last will and testament of Otto Zsehamisch, deceased. Plaintiff claimed an assessment from defendants as the alleged owners and holders of 95 shares of stock of the insolvent Cornwells State Bank.
