Plaintiff instituted an action in replevin to obtain bonds that he pledged with defendant as security for a loan. Following a trial by jury, a verdict was rendered for plaintiff for the return of his bonds or their equivalent in money.
On June 25,1957, plaintiff, Milford J. Meyer, at the suggestion of his friend, Max E. Cohen, signed an agreement with defendant, Industrial Valley Bank & Trust Company, wherein Meyer' agreed to pledge certain collateral to Industrial to secure a loan which Industrial would make to Cohen.
