Error to Circuit Court, Kanawha County. Tom Parley was convicted of unlawfully selling intoxicating liquors, and on appeal from the intermediate court.the, circuit court quashed the indictment and discharged accused,,, whereupon the State brought error.

Lynch, Judge:

Por unlawfully selling intoxicating liquors, defendant was1 convicted in the intermediate court 'of Kanawha : county.1' *472Upon review, the circuit court of that county reversed the judgment, quashed the indictment, and discharged the accused from further prosecution. Thereupon the state obtained this writ of error. The specific points presented for consideration are the denial of defendant’s motion for a continuance, rulings by the trial court on the admissibility of evidence, and the sufficiency of the indictment.
