Defendant having been charged with manslaughter, his counsel moved that the presiding judge of the trial court be recused, on the ground that prior to his (then) recent appointment to the bench he had been employed and consulted in the cause on behalf of the state and, further, moved that a lawyer having the necessary qualifications be appointed in his stead, or, if no such lawyer could be found at or during the then term of the court, that the judge of an adjoining parish be appointed to try the case.
