HIGGINS, Justice. •

The accused was originally indicted and tried for the murder of Bill Morgan. The case .resulted in a mistrial. The district attorney then filed a bill of information against the accused for manslaughter and on the trial thereof he was convicted and sentenced to not less than six nor more than eighteen years in the State Penitentiary. He has appealed and relies upon three bills of exception for the annullment of the verdict and sentence of the court.
