This case was commenced in the district court of Choctaw county by the plaintiffs in error against the defendant, in error, to recover damages upon breach of contract. Plaintiffs in error filed their briefs on the 12th day of April, 1915, and service of same was had upon defendant in error prior to the 20th of April. The defendant having failed to file its brief within the 30 days allowed under the rules of practice, time was extended to June 2, 1915.
