Petitioner instituted this CPLR article 78 proceeding, inter alia, for a judgment directing that he be returned to his position on the eligibility list for police officer (he had been removed from the list because the respondent Nassau County Civil Service Commission [the commission] determined that he failed to medically qualify as a police officer because of defective color vision), and to declare the standards promulgated by the respondent Municipal Police Training Council to measure color blindness to be arbitrary, capricious and unreasonable.
