ORDER GRANTING IN PART AND DENYING IN PART DEFENDANTS’ MOTION TO DISMISS
BRIMMER, District Judge.
This case arises from the production of coal bed methane in Northeastern Wyoming. The matter is currently before the Court on Defendant Hemmer and Beach’s Motion to Dismiss Plaintiffs Second Amended Complaint pursuant to Fed.R.Civ.P. 12(b) and Defendant Redstone Resources, Inc.’s Motion to Dismiss Plaintiffs Second Amended Complaint pursuant to Fed.R.Civ.P. 12(b).
