STATEMENT OF FACTS.
Appellant brought this suit for damages for personal injuries alleged to have been caused by the negligence of the railroad company resulting in the death of her intestate, Harrington Johnson.
The decedent was employed as section-hand at work on the track near Traskwood, and went to his home at Hope to spend Sunday, being directed by his foreman to come back on train. No. 6 on Sunday to begin work on Monday, the foreman at the time telling the hands that No. 6 would stop at the station for them on the return.
