BACKGROUND

This is a medical negligence action brought in March, 1997 by Troy Nunsuch (“Troy”) on behalf of his wife, Mary Esther Nunsuch (“Mary Esther”), for himself, and on behalf of their three minor children, Mary Alice, Tyrone, and Tray Nunsuch against the United States Government (Defendant). Mary Esther is a Navajo who is permanently mentally and physically incapacitated.
