From a judgment in favor of the defendant, based upon a verdict directed by the court after the plaintiff had rested, the appeal was taken which brings this case before us. The action was for damages for personal injuries received by plaintiff by being struck by one of defendant’s locomotives which was drawing a passenger train on defendant’s road. The accident occurred at a public crossing in the City of Grand Forks, in this state.
