This action was brought by appellee against the appellant, and its locomotive engineer, Frank Miller, for damages, for personal injuries, resulting from a collision alleged to have been caused by the negligence of appellant and said Miller in the operation of appellant’s train. The collision occurred at a crossing of the railroad company’s tracks and South East Street in the city of Indianapolis. The issues of fact were tendered by a complaint in one paragraph and a general denial thereof.
