The issues, are whether it was error to order a new trial in the interest of justice and whether it was error to award costs to one party prior to the new trial.

From the testimony adduced at the trial it appears that this accident occurred about one-quarter mile south of the unincorporated village of Spring Lake on County Trunk Highway F between the cities of Wautoma to the northwest and Berlin to the southeast.
