This is an action in equity. The appeal is from a judgment of the district court of Stirtsman county, entered on the 15th of August, 1923, in favor of the plaintiff. The action was commenced on June 23, 1923. A trial de novo is demanded in this court.

On the 17th of April, 1922, the plaintiff Jongewaard commenced an action against the defendants Gesquire and wife in the district court of Stutsman county to recover for services as a thresher, performed in the fall of 1920. By stipulation of the parties the place of trial was changed from Stutsman to Barnes county, North- Dakota, and judgment…
