This case presents to this court for review the correctness of the lower court’s ruling in sustaining a demurrer to the appellants’ declaration, upon which judgment was entered for the appellee and an appeal therefrom to this court entered by the appellants.
The facts set up in the declaration may be summarized as follows: Kendall owned a farm in Kent County, which he acquired from Coleman and others in 1920. On December 4, 1926, Kendall and wife granted and conveyed this farm to MacCubbin and wife and in the deed conveying the same covenanted “that he will warrant specially the property…
