NEALON, Chief Justice.

This is a suit brought by Alfonso Davis and wife against Cass County, Texas. It is pleaded in two counts. The first count is in the usual form of a petition in trespass to try title. The land involved is 55 acres in Cass County. The second count seeks to recover as damages the sum of $50 per acre alleged to have been received for an oil lease of the land. It-was alleged that the county judge, without authority from the commissioners’ court, caused plaintiffs to convey said land to the county, telling plaintiffs that he wanted a deed conveying said land to Cass County in…
