The' parties hereto—appellant the husband and plaintiff below, and appellee the wife and defendant below—were married in 1922. On August 20, 1936, plaintiff filed in the Boyd circuit court his petition against defendant seeking an absolute divorce from her, upon the ground of cruel and inhuman treatment 'followed by separation. Issue was made by defendant’s answer and the parties proceeded to prepare the case for-final submission.
