The plaintiff, Christine Donato, brought an action against Metropolitan Life Insurance Company (“MetLife”) under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1001-1461. Ms. Donato, a former employee of Kemper Financial Services (“Kemper”), sought a reinstatement of benefits under Kemper’s Long Term Disability Benefit Plan (the “Plan”), for which MetLife is the insurer and fiduciary.
