On the twenty-first day of March, 1908, one Clifford E. Youmans, a lineman of the Consolidated Telephone, Telegraph and Electric Company, was killed while engaged in repair work. In November, 1908, the appellant brought this action against the appellee, seeking a money judgment for the. death of Youmans, which was alleged to have been caused by appellee negligently permitting a highly charged wire to come in contact with the telephone line which decedent was repairing.
