This action was commenced in the district court of Carter county by defendant in error against plaintiffs in error. For convenience, parties will be referred to as they appeared in the trial court.

Plaintiff filed his petition on the 25th day of October, 1923, seeking to recover on insurance policies executed by defendants on certain property of plaintiff. Plaintiff’s petition alleged he was doing business at a certain location in the town of Ardmore. That on the 23rd day of December, 1922, defendants issued their insurance policy.
