The action is to recover $500, the amount of the deposit paid upon the purchase of certain vacant lots situate on East Two Hundred and Twenty-eighth street, in the borough of the Bronx, city of Hew York, and interest at the rate of four per cent, from February 28, 1908, and to establish and enforce a lien therefor. The contract in suit was entered into on February 28, 1908, and, according to its terms, was to be closed on April 28, 1908, sixty days *452thereafter, at which time the defendant was to deliver a deed to the property and to pay the balance of the purchase price in the manner provided…
