MEMORANDUM AND ORDER

KOPF, Chief Judge.

This matter is before the court on the defendant’s motion for summary judgment (filing 51). Upon careful consideration of the pleadings, filed affidavits, and briefs submitted by the parties, I find that the motion should be granted. 1

I. BACKGROUND

This is an employment discrimination case brought pursuant to the Civil Rights Act of 1964 (Title VII), 42 U.S.C. §§ 2000e to 2000e-17, the Civil Rights Act of 1886 (Section 1981), 42 U.S.C. § 1981, and the Nebraska Fair Employment Practice Act (FEPA), Neb.Rev.Stat. §§ 48-1101 to 48-1125.
