This case presents the question of whether or not a reservation in a deed, reserving a certain interest in the oil and gas royalty from the land conveyed, is valid. It is shown by the record that in 1909, W. D. Engles and Maggie J. Engles and Joseph Bruner and Maggie E. Bruner were the owners of the southeast quarter of section nine, township 18, range 11 east. The Engles owning three-fourths of the fee andi the Bruners one-fourth; and on May 10, 1909, they entered into a voluntary partition of this quarter section, the Bruners taking the southwest quarter of the southeast…
