INTRODUCTION
Having prevailed before a unanimous three-member arbitration panel, Midwest Generation EME, LLC (“Midwest”) has moved to confirm the award. Continuum Chemical Corporation (“Continuum”) has filed a petition to vacate the award, based on the “evident partiality” of one of the arbitrators, Stanley Sklar.
