On this day, the Court considered Petitioner’s pro se “[Petition for] Writ of Man damus [U]nder 28 U.S.C. § 1361[,] Motion Pursuant to [] 28 U.S.C. § 2241[, a]nd Complaint for Declaratory Judgment Pursuant to [ ] 28 U.S.C. § 2201” (“Petition”) (Doc. No. 5). For the reasons set forth herein, the Petition is hereby DISMISSED without prejudice. Additionally, the United States Citizenship and Immigration Services (“CIS”) Decision, dated December 18, 2006, is hereby VACATED as improvidently granted.
